Today, I will be starting a series on reasons to talk to an estate planning attorney.
Let’s start with a less obvious one.
Up until now, parent(s) and/or guardian have been able to talk to your doctor, handle bills, and, in the unfortunate even of a medical emergency, take charge. After that magical 18th birthday, suddenly the doctor can’t release information because of HIPAA, creditors and third parties want to talk to you directly, and, in the unfortunate event of a medical emergency, parents may find that they have to go through the expensive and invasive process of obtaining guardianship in order to take over decision-making.
Instead of waiting until this becomes an expensive problem, you can get certain documents in place now to not only ensure that someone can make decisions for you and obtain information when needed, but, more importantly, ensure the RIGHT someone has that power.
